Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FlightAtom website, platform, and services provided by FlightAtom LLC ("FlightAtom," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

FlightAtom provides cloud-based aviation operations software, including but not limited to crew management, flight operations, training management, safety intelligence, and AI-powered tools. Access to specific modules and features depends on your subscription agreement.

2. Account Registration

To access certain features, you must create an account through our Client Portal. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3. Acceptable Use

You agree not to:

• Use the services for any unlawful purpose or in violation of aviation regulations
• Attempt to gain unauthorized access to any part of the platform
• Interfere with or disrupt the integrity or performance of the services
• Reverse engineer, decompile, or disassemble any part of the software
• Share your account credentials with unauthorized parties
• Use the services to transmit malicious code or harmful content

4. Intellectual Property

All content, features, and functionality of the FlightAtom platform — including software, text, graphics, logos, and design — are owned by FlightAtom LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the services as permitted under your subscription agreement.

5. Data Ownership

You retain ownership of all data you input into the FlightAtom platform ("Customer Data"). You grant FlightAtom a limited license to process Customer Data solely for the purpose of providing and improving our services. We will not access, use, or share your Customer Data except as necessary to deliver the services or as required by law.

6. Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for temporary service disruptions caused by factors beyond our reasonable control.

7. Payment Terms

If you have a paid subscription, payment terms are governed by your separate subscription agreement. All fees are non-refundable unless otherwise specified in your agreement. We reserve the right to modify pricing with 30 days' notice.

8. Limitation of Liability

To the maximum extent permitted by law, FlightAtom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the services. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

Aviation Disclaimer: FlightAtom software is a decision-support tool and does not replace the judgment of qualified aviation professionals. All operational decisions, including but not limited to crew scheduling, flight planning, and safety assessments, remain the responsibility of appropriately certified personnel.

9. Indemnification

You agree to indemnify and hold FlightAtom harmless from any claims, damages, or expenses arising from your use of the services, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the services at any time for violation of these Terms, with notice where practical. Upon termination, your right to use the services ceases immediately. We will provide reasonable opportunity to export your Customer Data before account deletion.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the platform. Your continued use of the services after such notification constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
